Terms of Use

These Terms of Use govern your access to and use of Iyari. By downloading, accessing, or using Iyari, you agree to these Terms.

1. Purpose of IYARI

Iyari is a mobile application designed to help users capture structured field data, including forms, georeferenced records, photos, map-based records, and export-ready datasets.

Iyari is intended for professional, technical, educational, environmental, geological, civil, geotechnical, social, and general field data collection workflows.

2. Offline-first functionality

Iyari is designed as an offline-first application. Many features store data locally on your device.

You are responsible for backing up, exporting, and protecting your own data. We are not responsible for data loss caused by device failure, accidental deletion, operating system issues, app removal, lack of backups, or improper use of exported files.

3. User responsibility

You are responsible for the accuracy, legality, and proper use of the data you collect with Iyari.

You agree not to use Iyari to collect, store, export, or share information in a way that violates applicable laws, confidentiality obligations, workplace policies, intellectual property rights, privacy rights, or third-party rights.

4. Fieldwork and safety

Iyari is a digital tool for data collection. It does not replace professional judgment, safety procedures, field protocols, legal permits, technical standards, or expert supervision.

You are responsible for conducting fieldwork safely and complying with all applicable workplace, environmental, land access, community, and regulatory requirements.

5. Location accuracy and technical limitations

Iyari may use GPS, device sensors, imported maps, coordinate conversions, or orientation tools. Accuracy may vary depending on your device, signal quality, environment, sensor calibration, imported map quality, and user input.

Iyari does not guarantee survey-grade accuracy. You should verify critical coordinates, measurements, orientations, and exported data before using them for professional, legal, engineering, scientific, regulatory, or commercial decisions.

6. Photos, maps and imported files

You are responsible for ensuring that you have the right to use any photos, maps, GeoPDFs, documents, templates, or files imported into Iyari.

You must not import, export, or distribute files that infringe copyright, contain confidential information without authorization, or violate third-party rights.

7. Free and paid features

Iyari may offer free features and paid features, including subscriptions or premium functionality.

Paid features may be managed through Google Play, Apple App Store, or another authorized payment provider. Subscription terms, renewals, cancellations, billing, and refunds may be subject to the policies of the platform where you purchased the subscription.

8. Intellectual property

Iyari, including its design, interface, name, logo, software, structure, and related materials, is owned by Rockswise S.A.S. or its licensors.

These Terms do not transfer ownership of IYARI to you. You receive a limited, non-exclusive, non-transferable license to use the app according to these Terms.

9. Your data

You retain ownership of the field data, forms, photos, notes, coordinates, maps, and files that you create or import into Iyari.

You are responsible for managing, exporting, deleting, backing up, and protecting your data.

10. Prohibited use

You agree not to:

• Reverse engineer, copy, modify, or redistribute IYARI without authorization.
• Use Iyari to violate laws or third-party rights.
• Attempt to bypass payment, subscription, licensing, or security systems.
• Use IYARI in a way that could damage, disable, or interfere with the app or related services.
• Misrepresent exported data as verified, certified, or survey-grade when it has not been independently validated.

11. No professional certification

IYARI is a data capture and organization tool. It does not provide certified surveying, engineering, geological, legal, environmental, safety, or regulatory advice.

Any professional interpretation, reporting, certification, or decision based on data collected with IYARI remains your responsibility.

12. Disclaimer of warranties

Iyari is provided on an “as is” and “as available” basis. We do not guarantee that the app will be error-free, uninterrupted, compatible with every device, or suitable for every field condition or professional use case.

To the maximum extent permitted by law, we disclaim all warranties, whether express or implied.

13. Limitation of liability

To the maximum extent permitted by law, Rockswise will not be liable for indirect, incidental, consequential, special, or exemplary damages, including data loss, lost profits, business interruption, fieldwork delays, inaccurate records, or decisions made based on exported data.

14. Changes to the app

We may update, modify, add, or remove features from IYARI over time. Some features may require payment, subscription, internet access, platform permissions, or compatible devices.

15. Termination

We may suspend or terminate access to IYARI if you violate these Terms, misuse the app, attempt to bypass payment systems, or use the app in a way that creates legal, technical, or security risks.

16. Governing law

These Terms are governed by the laws of Ecuador, unless mandatory consumer protection laws in your country require otherwise.
