Terms of Use

These Terms of Use govern your access to and use of Iyari. By downloading, accessing, or using Iyari, you agree to these Terms.

1. Purpose of Iyari

Iyari is a mobile application designed to help users capture, organize, review, and export structured field data, including forms, georeferenced records, photos, map-based records, and export-ready datasets.

Iyari is intended for professional, technical, educational, environmental, geological, civil, geotechnical, social, and general field data collection workflows.

2. Offline-first functionality

Iyari is designed as an offline-first application. Many features operate and store field data locally on your device.

You are responsible for backing up, exporting, and protecting your own data. Rockswise S.A.S. is not responsible for data loss caused by device failure, accidental deletion, operating system issues, app removal, lack of backups, corrupted files, or improper use of exported data.

3. User responsibility

You are responsible for the accuracy, legality, completeness, and proper use of the information you collect or manage with Iyari.

You agree not to use Iyari to collect, store, export, or share information in a way that violates applicable laws, confidentiality obligations, workplace policies, intellectual property rights, privacy rights, or other third-party rights.

4. Fieldwork and safety

Iyari is a digital field data collection tool. It does not replace professional judgment, safety procedures, field protocols, legal permits, technical standards, risk assessments, or expert supervision.

You are responsible for conducting fieldwork safely and complying with applicable workplace, environmental, land access, community, and regulatory requirements.

5. Location accuracy and technical limitations

Iyari may use GPS, device sensors, imported maps, coordinate conversions, orientation tools, and other device capabilities.

Accuracy may vary depending on your device, signal quality, environmental conditions, sensor calibration, magnetic interference, imported map quality, device compatibility, and user input.

Iyari does not guarantee survey-grade accuracy. Critical coordinates, measurements, orientations, calculations, and exported information should be independently verified before being used for professional, legal, engineering, scientific, regulatory, safety, or commercial decisions.

6. Photos, maps and imported files

You are responsible for ensuring that you have the right to use any photos, maps, GeoPDFs, documents, templates, or other files that you import, create, or manage with Iyari.

You must not import, export, reproduce, or distribute content that infringes copyright, contains confidential information without authorization, or otherwise violates applicable law or third-party rights.

7. Free and paid features

Iyari may provide both free functionality and paid functionality, including Iyari Plus.

Paid features may be purchased or managed through Lemon Squeezy, Google Play, the Apple App Store, or another authorized payment provider.

Subscriptions may renew automatically according to the terms presented at the time of purchase and the rules of the applicable payment provider. You are responsible for managing your subscription and renewal settings through the applicable purchase channel.

Refund requests and eligibility are governed by our Refund Policy and, where applicable, the rules and legal obligations of the payment provider.

Lemon Squeezy currently acts as Merchant of Record for purchases made through its checkout, while native purchases are governed by their respective store systems.

8. Account and licence access

Certain Iyari Plus features may require authentication and verification of an active licence or subscription.

Access to paid features is associated with the relevant Iyari account or licence and may be subject to device authorization limits displayed within the app or communicated as part of the service.

You may not attempt to bypass, manipulate, duplicate, transfer, or interfere with Iyari’s authentication, subscription, licence, device authorization, or access-control systems.

9. Intellectual property

Iyari, including its software, design, interface, name, logo, visual elements, structure, documentation, and related materials, is owned by Rockswise or its licensors and is protected by applicable intellectual property laws.

These Terms do not transfer ownership of Iyari to you.

Subject to these Terms, you receive a limited, non-exclusive, revocable, and non-transferable right to use Iyari for its intended purposes.

10. Your content and field data

You retain ownership of the field records, forms, photos, notes, coordinates, maps, templates, and other content that you create or lawfully import into Iyari.

Nothing in these Terms transfers ownership of that content to Rockswise.

Information about how Iyari handles personal information and locally stored field data is provided separately in our Privacy Policy.

11. Prohibited use

You agree not to:

• Reverse engineer, copy, modify, reproduce, or redistribute Iyari except where expressly permitted by law.
• Use Iyari in violation of applicable laws or third-party rights.
• Attempt to bypass payment, subscription, licence, authentication, device authorization, or security systems.
• Interfere with, damage, disrupt, or misuse Iyari or related services.
• Use unauthorized methods to obtain paid functionality.
• Misrepresent data generated or managed with Iyari as certified, verified, or survey-grade when it has not been independently validated.

12. No professional certification

Iyari is a data capture, organization, and export tool.

It does not provide certified surveying, engineering, geological, environmental, legal, safety, regulatory, or other professional advice or certification.

Any professional interpretation, analysis, reporting, certification, or decision based on information collected or managed with Iyari remains the responsibility of the user and the relevant qualified professional.

13. Third-party services

Some Iyari functionality may depend on third-party platforms, operating systems, app stores, mapping services, payment providers, email services, or other external technologies.

Those services may be governed by their own terms and may change, become unavailable, or operate differently depending on your device, country, platform, or provider.

Rockswise does not control the availability or operation of independent third-party services.

14. Disclaimer of warranties

Iyari is provided on an “as is” and “as available” basis.

We do not guarantee that Iyari will always be uninterrupted, error-free, compatible with every device, suitable for every field condition, or appropriate for every professional use case.

To the maximum extent permitted by applicable law, Rockswise disclaims warranties that may otherwise arise in connection with use of the app, except for rights and warranties that cannot legally be excluded.

15. Limitation of liability

To the maximum extent permitted by applicable law, Rockswise will not be liable for indirect, incidental, consequential, special, or exemplary damages arising from the use of Iyari, including data loss, lost profits, business interruption, fieldwork delays, inaccurate records, device failure, or decisions made using collected or exported information.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

16. Changes to Iyari

We may update, improve, modify, add, restrict, or remove features from Iyari over time.

Some functionality may require internet access, platform permissions, compatible hardware, authentication, an active subscription, or a particular operating system or app version.

17. Suspension or termination

We may restrict, suspend, or terminate access to Iyari services or paid functionality where reasonably necessary if you materially violate these Terms, misuse the service, attempt to bypass access or payment systems, engage in fraudulent activity, or create legal, technical, security, or operational risks.

Expiration or termination of paid access does not transfer ownership of your locally stored field data to Rockswise.

18. Changes to these Terms

We may update these Terms from time to time to reflect changes to Iyari, applicable laws, payment systems, or business practices.

When material changes are made, we will update the effective date and, where appropriate, provide notice through the app or website.

Continued use of Iyari after updated Terms take effect constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

19. Consumer rights

Nothing in these Terms is intended to exclude, restrict, or modify any consumer right, remedy, guarantee, or protection that cannot legally be excluded under applicable law.

Where mandatory consumer protection laws apply, those laws take precedence over any conflicting provision in these Terms.
